1. Data Controller

Albarosa ApS is the data controller for the processing of your personal data in connection with enquiries submitted through our website, lead forms, and any services we provide.

1.1. Contact Details

If you have questions about the processing of your personal data, you are welcome to contact us:

Albarosa ApS
Sønderborg, Denmark
CVR: 46542193 · VAT: DK46542193
Phone: +45 52 51 34 63
Email: hello@albarosa.net

2. Purpose of Processing Personal Data

The purposes of processing your personal data are to handle your enquiries, deliver our services, and maintain the business relationship between you and Albarosa ApS.

2.1. Legal Basis for Processing

Processing of personal data submitted through our contact and lead forms is based on our legitimate interest in being able to respond to enquiries professionally and in a timely manner, and to document any agreements entered into.

Where you have provided consent — for example by opting in to marketing communications — processing is based on that consent. You may withdraw your consent at any time by contacting us at hello@albarosa.net.

Processing necessary to fulfil a service agreement with you is based on the performance of that contract.

3. Categories of Recipients

Your personal data may be passed to our data processors, including CRM platforms, email tools, and website analytics services, solely for the purpose of delivering our services. All data processors are bound by data processing agreements and may not use your data for their own purposes.

3.1. Recipients in Third Countries

Some of the tools we use may transfer personal data outside the EU/EEA. A third country is any country outside the EU/EEA. Where such transfers occur, they are based on the European Commission's standard contractual clauses or another valid transfer mechanism under GDPR Chapter V.

Your personal data is not transferred to international organisations such as the UN, EU, or NATO.

4. Retention Period

Personal data submitted through enquiry and lead forms is retained for as long as necessary to handle your request and maintain the business relationship, and for no longer than 3 years after the last contact, unless a longer retention period is required by law.

Data processed as part of an active service agreement is retained for the duration of the agreement and for 5 years thereafter in accordance with Danish bookkeeping requirements.

5. Obligations

Providing your personal data is a prerequisite for us to be able to respond to your enquiry or deliver our services. Without this information, we will not be able to process your request or enter into a service agreement.

6. Your Rights

Under the General Data Protection Regulation (GDPR), you have a number of rights in relation to our processing of your personal data.

To exercise any of the rights below, please contact us at hello@albarosa.net.

6.1. Right of Access

You have the right to obtain access to the personal data we process about you, as well as a copy of that data.

6.2. Right to Rectification

You have the right to have inaccurate personal data about yourself corrected.

6.3. Right to Erasure

In certain circumstances you have the right to have personal data about yourself erased.

6.4. Right to Restriction of Processing

In certain circumstances you have the right to have the processing of your personal data restricted. If you have the right to restriction, we may only process the data — apart from storage — with your consent, or for the establishment, exercise, or defence of legal claims, or to protect a person or important public interests.

6.5. Right to Object

In certain circumstances you have the right to object to our processing of your personal data, including processing based on our legitimate interests.

6.6. Right to Data Portability

Where processing is based on your consent or on a contract, you have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format.

7. Cookies and Similar Technologies

Our website uses cookies and similar technologies, including data stored in your browser's local storage, to make the site work and, where you have given your consent, to understand how the site is used.

7.1. Necessary Cookies

These cookies are required for the website to function and are not subject to the cookie consent banner. They are used, for example, to remember your cookie choice and language preference, and to enable the live chat feature used to contact us. We treat live chat as strictly necessary, since it is a core feature of the site that you actively choose to use to get in touch with us. It therefore runs on every page regardless of the cookie choice described below.

7.2. Analytics Cookies (Optional)

These are only loaded if you click "Accept all" in our cookie banner, and are used to help us understand how visitors use the site so we can improve it. You can change your choice at any time via "Cookie settings" in the footer.

When you make a choice in the cookie banner, we record that choice (accept/decline) as an anonymous, one-off event so we can measure consent rates. This record is not linked to your identity and does not itself set a persistent cookie.

7.3. Managing Your Cookie Choice

You can change your cookie choice at any time using the "Cookie settings" link in the footer of our website. You can also block or delete cookies through your browser settings, though this may affect the functionality of some parts of the site.

8. The Danish Data Protection Agency (Datatilsynet)

You can read more about your rights in the Danish Data Protection Agency's guidance on the rights of data subjects, which you can find at www.datatilsynet.dk. You may also file a complaint with Datatilsynet at the same address.
